This disclosure is provided by Veracious Developments Inc. in accordance with the requirements of the New Home Construction Licensing Act, 2017, S.O. 2017, c. 33, Sched. 1 (the "Act"), and the regulations of the Home Construction Regulatory Authority ("HCRA"). This page is intended to inform prospective purchasers of their rights and protections under Ontario law when purchasing a new home from a licensed builder.
Veracious Developments Inc. is a licensed new home builder and vendor in the Province of Ontario, regulated by the Home Construction Regulatory Authority (HCRA). The HCRA is the regulatory body responsible for licensing builders and vendors of new homes under the Act, and for enforcing standards of competence, financial responsibility, and ethical conduct in the new home construction industry.
Prospective purchasers may verify the licensing status and conduct history of Veracious Developments Inc. through the Ontario Builder Directory maintained by the HCRA at: www.hcra.ca. The Ontario Builder Directory provides publicly accessible information regarding a builder's licence status, conditions, disciplinary history, and customer complaints.
Every new home built and sold by Veracious Developments Inc. is enrolled in the Tarion New Home Warranty Program, administered by Tarion Warranty Corporation pursuant to the Ontario New Home Warranties Plan Act, R.S.O. 1990, c. O.31 (the "Warranty Act"). Enrolment in this program is mandatory for all licensed new home builders in Ontario.
As a purchaser of a new home from Veracious Developments Inc., you are entitled to the following statutory warranty protections under the Warranty Act:
One-Year Warranty: Coverage for defects in work and materials, including violations of the Ontario Building Code, commencing on the date of possession. Two-Year Warranty: Coverage for water penetration through the building envelope, defects in materials and work in the electrical, plumbing, and heating delivery and distribution systems, and defects in work or materials that result in the detachment, displacement, or deterioration of exterior cladding. Seven-Year Warranty: Coverage for major structural defects (MSDs), defined as defects in load-bearing elements of the home that diminish the structural integrity of the home.
Deposit Protection: Tarion also provides deposit protection for qualifying purchasers. The maximum insured deposit amounts are established by regulation and are subject to change. Purchasers should review the applicable deposit protection provisions with their solicitor prior to executing any Agreement of Purchase and Sale.
Prior to closing, Veracious Developments Inc. will conduct a Pre-Delivery Inspection (PDI) with each purchaser. The PDI is a formal inspection of the completed home, conducted in accordance with Tarion guidelines, during which the builder demonstrates the operation of the home's systems and documents any incomplete items or defects. The PDI form is a legally significant document and will be used to establish baseline conditions at the time of possession.
Warranty claims must be submitted to Tarion through the MyHome portal at: myhome.tarion.com. Submission deadlines are strictly enforced. Purchasers are advised to review the Tarion warranty submission schedule carefully, including deadlines for the 30-day, Year-End, and Second-Year warranty submissions. Ontario law provides purchasers of new homes with statutory rights in the event of delayed closing or delayed occupancy. Where Veracious Developments Inc. is required to delay a closing date, written notice will be provided in accordance with the timelines prescribed by regulation. Purchasers may be entitled to compensation for qualifying delayed closings in accordance with the Tarion delayed closing warranty. The terms of your Agreement of Purchase and Sale and applicable Tarion guidelines govern these entitlements.
